Terms of Service

OWNERSHIP OF WORK

Photographer will own all right, title and interest in all Work Product. Client (on behalf of itself and any attendees) hereby grants Photographer and any of its service providers an exclusive, royalty-free, worldwide, irrevocable, transferable and sublicensable license to use any materials created by Client or attendees, during the performance of the Services, that may be protected by copyright or any intellectual property rights as part of any Work Product or in connection with the marketing, advertising or promotion of Photographer’s services, including in connection with Photographer’s studio, portfolio, website or social media, in any format or medium. Client acknowledges and affirms that no other person or entity has any rights that may prevent or restrict Photographer from using the materials as provided herein. When booking Gray & Bear as a Photographer, please note you are booking for their style of work & editing. RAW images will NOT be provided to clients.

LIABILITY

Photographer will not be liable for any damage or loss of client's personal belongings. Photographer will not be liable to any injury caused at your photoshoot including injury caused by an animal.

DEPOSIT

If client is a no-show at their scheduled time, they forfeit their non-refundable deposit. Session fee is to be paid before the date unless prior arrangements have been agreed upon by both Photographer & client.

If client is wanting to reschedule and Photographer had to wait more than 15 minutes with no communication of tardiness or client not arriving when they stated they would, Photographer is entitled to $150 deposit and the remainder will go towards rescheduled session within a 2 week time frame.

When making a booking for a session (excluding weddings as they have their own contract terms & conditions), there will be a $150 non-refundable deposit which will be paid to secure the booking time. If the client does not make communication & make payment within 24 hours, unless agreed upon by both Photographer & client, the session time will become available to other potential clients. If client is needing to reschedule date & excuse is legitimate, rescheduling may happen once more before client loses deposit (this excludes if Photographer deems weather to be bad enough to warrant rescheduling. For outdoor sessions ONLY).

Images & galleries are kept for 3 months so please download all images before this time. Photographer is not held liable if client can no longer access images as they hadn't downloaded them.

GALLERIES

Galleries will only include number of purchased images. A 'Full Gallery' refers to 50+ images, not every single image taken of that session or every single image in preview gallery. Photographer chooses 50+ of the best images in that gallery to send to client. (Full gallery = max of 70 images)
